Welcome to Botanist Maintenance! By using our irrigation management services through Hydrawise, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. Acceptance of Terms

By accessing or using our services, you accept and agree to be bound by these Terms and Conditions. If you do not agree, you should not use our services.

2. Service Description

Botanist Maintenance offers irrigation management services utilizing the Hydrawise platform to ensure efficient water usage and system monitoring for clients in Arizona. Our services include:

  • Monitoring irrigation system performance through Hydrawise.

  • Scheduling and adjusting watering cycles remotely.

  • Providing maintenance alerts and troubleshooting assistance.

3. Eligibility

Our services are only available to existing clients of Botanist of the Valley who have an active Hydrawise system installed. By using our services, you represent that you meet this requirement.

4. Service Fees and Payments

By subscribing to our service, you agree to pay the applicable fees.

  • Monthly Subscription: Our irrigation management services are offered at a monthly rate of $9.99, $19.99, $34.99

  • Payment Terms: Fees will be charged to your designated payment method on a monthly basis. You are responsible for ensuring that your payment information is accurate and up-to-date.

  • Late Payments: Failure to pay the subscription fees on time may result in suspension or termination of your service.

5. Use of Services

You agree to use our services in a lawful manner and for their intended purpose. You must not:

  • Interfere with or disrupt the functionality of the Hydrawise platform or our services.

  • Attempt to access systems, data, or information that you are not authorized to access.

  • Use the services for any illegal or unauthorized purpose.

6. Client Responsibilities

As a client, you are responsible for:

  • Providing accurate contact and irrigation system details.

  • Maintaining your irrigation system hardware and ensuring it is compatible with the Hydrawise platform.

  • Ensuring any necessary access to your property for maintenance or troubleshooting.

7. Service Availability

While we strive to ensure that our services are available at all times, we do not guarantee uninterrupted or error-free service. Temporary interruptions may occur due to maintenance, system updates, or unforeseen issues beyond our control.

8. Limitation of Liability

Botanist Maintenance is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services, including but not limited to:

  • System malfunctions or hardware failures.

  • Improper irrigation settings or water usage.

  • Property damage resulting from irrigation issues.

We do not assume responsibility for issues caused by faulty hardware, improper installation, or unauthorized modifications to your irrigation system.

9. Termination

Either party may terminate these Terms and Conditions at any time. Upon termination, you will no longer have access to our services, and any outstanding payments will be due immediately. We reserve the right to terminate or suspend service for any client who fails to comply with these Terms and Conditions.

10. Intellectual Property

All content, materials, trademarks, logos, and intellectual property associated with Botanist Maintenance and Hydrawise are owned by their respective owners. You are granted a limited, non-exclusive right to use the services for their intended purpose. You may not copy, modify, distribute, or reverse-engineer any part of our services.

11. Governing Law

These Terms and Conditions are governed by the laws of the state of Arizona, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these terms will be resolved in the courts of Arizona.

12. Changes to Terms

We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting the updated terms on our website. Continued use of our services after changes constitutes acceptance of the new terms.
